The Lawyer has announced that the replacement for David Green is Lisa Osofsky - former Deputy GC at the FBI, no less. If this is accurate then, coupled with the recent Bribery Act corporate conviction in R v Skansen Interiors, SMEs need to take the Bribery Act seriously.
R v Skansen Interiors is the first conviction of a corporate for failure to prevent bribery. Skansen was found not to have adequate procedures in place to prevent bribery. In my experience, most SMEs are in the same position and those that aren't often seek off the shelf policies to provide an adequate procedure fig leaf, which is really not likely to provide the protection that they ought to be seeking.
